Abstract

Discourse on women's jurisprudence in the public sphere has been ongoing since the period of the scholars of the past schools.This discourse continues to flow into the contemporary era, including in Indonesia.In the 1970s, many female syar'iyah  scholars graduated from the syar'ia faculty of IAIN in Indonesia.The dynamics of Islamic legal thought continue to revolve around the question of whether women can become judges.Some Indonesian clerics, with strong arguments, allow women to become judges in religious courts.Among the institutions that permit this is the Muhammadiyah Tarih Council In the 1970s, this institution issued a decision in a small book entitled Adabul Mar'ah Fil Islam. A book of guidance for women in both the public and family spheres. This research model is qualitative by studying this book and supported by other literature to get maximum results. In short, this book provides guidance for women in the household and public sphere.In a household, a wife is a housewife who has the responsibility to create a happy household, while in the public sphere, A woman may occupy the position of judge, hospital director, company director and others as long as she has the ability. This decision still refers to religious arguments, the Qur'an and hadith with re-interpretation. Or a contextual approach in accordance with the spirit of the verses of the Qur'an and hadith when they were revealed and spoken
