Abstract

This research aims to analyze the basic differences between PKWT and PKWTT and their impact on legal protection and worker welfare. By understanding these two types of work agreements, it is hoped that we can provide clear guidelines for workers and employers in preparing agreements that comply with applicable laws and regulations. The employment agreement is the legal basis for the relationship between workers and employers in the world of employment. In general, work agreements are divided into two types, namely Specific Time Work Agreements and Indefinite Time Work Agreements. Indefinite Time Work Agreements are regulated in Article 56 of Law Number 13 of 2003 concerning Employment and are clarified in Government Regulation Number 35 of 2021, which regulates the limits on the types of work permitted for PKWT as well as legal consequences if the employer violates these provisions. On the other hand, PKWTT provides stronger legal protection for workers because it is permanent and allows workers to obtain rights such as job security, benefits and other rights
